Why Samak should stay and the New Politics should die

The PAD justifies their various demands on the basis of the government's incompetence and corruption. "Robbery" of the country, in Piset's words.

Yes, incompetence and corruption are considered a crime. But, like any other crimes, it should be dealt with by legal and constitutional means. Just like trying drug traffickers should be done in court and not through extrajudiciary killings by the police.

Yes, staging a peaceful protest to criticize the government is totally fine, but forcing an elected government out of the office using every means possible and without respect of the rule of law is not.

There are legal and constitutional means through which an elected government can be removed from office. For example, the Election Committee's suggestion that the PPP should be dissolved may lead to the end of this government. Now, that's a constitutional means to punish a "criminal".

Bypassing the legal and constitutional process by forcing an elected government out using costly and irresponsible means is wrong. This short-circuting of the process is a complete disrespect for the rule of law and of the majority who voted this government into the office. That, like corruption, is a crime too.

The PAD's proposal of "New Politics", in which a big portion of the MPs will be appointed rather than elected, is a regressive idea and also a crime. It is a crime of denying the right of Thai citizens to have a say in the governing of the country. 

This kind of politics is undemocratic and totally unacceptable. It looks down on the majority of the population while adoring some educated elites whom the PAD believes are so saintly and moral that they, and only they, know how best the country should be run. This proposal of "rule by a few" is a huge step backward for democracy and is a serious crime against every citizen of this country. We cannot let that happen.

A message for all PAD supporters: please understand that it is one thing to hate Thaksin/Samak, it is another to go against electoral process by supporting the idea of "New Politics". The two are seprate issues and it should not be the case that because you are anti-Samak, you must support the "New Politics".

In any case, I believe Samak, despite his government's ills, should stay on to power. Why? Because staying on to power is the only way that the rule of law and constitutional means can be used to remove the government.

If the PAD forces the government out now, social division will become deeper and the Thai public will never witness how the constitutional means could in fact settle a political problem or crime. Just like staging the 2006 coup has not solved any problems in Thai politics, the PAD's stubborn protest, if successful in bringing doen Samak, would not solve any problems too. The society will remain divided (or become more divided) and corruption will continue as usual. The country will still be in chaos, politically, economically and socially.

Give the law a chance to prove itself. The incompetence and corruption of a government will bring it down some day, but this will be achieved through legal and constitutional means, not by a group of protesters seizing the government house and closing down places. 

For the sake of the country and its people, the PAD should stop doing what they are doing now and retreat to peaceful protests within the rule of law. It should also stop their stupid proposal for "New Politics"; instead, it should focus its energy on thinking about how best to improve the performance of the electoral process and parlimentary democracy based on the fundamental belief that every Thai is equal.

In any case, the latest announcement from the PAD on "New Politics" shows that it has softened its tone on the 70-30 formula. The PAD states that it just wants to see a new politics in which "good people" are in politics and "bad people" are prevented from coming into office. Also, it states that there should be representatives from various sectors, occupation and so on.

Well, it is a big question in which the Thai society needs to find the answer together. How do we make politics "better"? And indeed Patriot's blog has started this discussion. I will try to find time to contribute as well.

I'm so busy I don't have time to blog in recent days. In any case, Samak has been removed from the post through constitutional means (although the constitution is controversial). There was no need for the PAD to seize the government house or airports or disrupt other public services. If Samak does something against the law, the law can find him and it just did...

Election mandate, the mandate to form a governing body does not mean the mandate to keep the election mandate effective and endurable.
Once the ruler commit mistake and if the mistake weighs enough, the ruler must resign and give others to rule instead, There are many more people who can do better.

This is real democracy.

PAD is not a poltical equity, at least not yet.
They are people who makes the laws.

Election mandate does not guarantee the ruling mandate.
Morality failure during governing is enough to quit.
The violation to the constitution, it is not enough to quit but must be immediately punished.
Both are the case of failure on the ruling mandate.

Election mandate never forgives a crime.
Changing the law cannot give amnesty to the criminals.

I agree 100%. Samak should stay in jail because he is a convicted criminal, sentenced by a Thai court to a 2-year prison term.

He has absolutely no right to be a prime minister even if he is out on appeal. I know of no other country in the world where a convicted criminal can be "appointed" by a criminal-on-the-run as a country's prime minister except in Thailand, disrespecting the people's wishes. Don't the politicians in this country have any shame at all?

And you call this D-E-M-O-C-R-A-C-Y? It sounds more like demon-crazy to me!

Now that the PAD with their demands are showing their true colours, it should be clear who are their backers and manipulators. Simply ask yourself who stands most to gain from a predominantly appointed government.

Shouldn't this question be asked of the government? Isn't that their mandate?

I agree that most of the PADs plan is bad and certainly regressive, but they at least have a plan.

Who will select the appointed senators? Will they be less corrupt because they haven't been elected?

Although not competely agree on PAD's 70 selectoral 30 electoral parliamentary system, I recently came to a belief that, Thailand is a transcient democracy that need a proper guardianship principle.

Closely watching the behavior of the north and the northeastern based PPP party members and their cabinet members, the inability of governing national agenda, the intented embazzlement of tax money, intented manipulating the constitution and the laws, easier resorting to state planned lynch mobstery, disobeyance to the law and own well-being seeking attitude of leader, indifference to people's interest,

This PPP and coalition party leaders must be bayed off from central poltics.

If I borrow the skill of speech from Samak, I may say,
" Let's try 70 30 if no one can prove its pros and cons" or " How do you know if it is good or not before trying on it ".

After trying this new poltical system for next 10 or 20 years and enough when the people CHANGED THE GENERATION and new generation of majority of conscious class of people with conscious honest new generation of politicians would lead the country, Thailand can adopt full style of liberal democratic democracy and system.
